Employment
The fees that are charged for an employment tribunal work will vary depending upon whether or not employer and employee.
We will offer to you to the outset and initial interview for one hour at a fixed cost £200 plus VAT to enable us to assess the initial strength and weaknesses of your case.
It may be that you have the benefit of litigation insurance or insurance cover for claims of this nature in which case you may be referred to a panel Solicitor and in which case we will only charge you for the initial interview. If we take on your case than we will need to set out the potential costs that you may incur.
These costs will depend upon the nature of your case, the number of parties involved, a number of issues involved, together with the length of hearing that is likely to take place at employment tribunal.
Typical fees fall into three bands as follows:
- Simple claim defined as unfair dismissal claim with a one-day hearing - estimate of costs £6,000-£10,000 plus VAT total £7,200 - £12,000 including VAT
- Unfair dismissal claim or equivalent with a two to three day hearing - £10,000 to £15,000 plus VAT totalling £12-£18,000 including VAT
- Complex case of unfair dismissal lasting three days or more - £12,500 - £25,000 plus VAT
You may also incur barrister fees if the hearing is to last more than three days and these will be estimated at the region of £3,000 per day plus VAT
The barristers fees will be a disbursement and will be in addition to the basic costs of us conducting the case on your behalf.
If issues arise during the course of the conduct of your work then we will discuss these with you at the relevant stage. This may lead to an increase in disbursements.
The ultimate cost of each case will depend upon the number of complainants, the number of witnesses, the number of documents that are presented and reviewed, and the number of documents that would have to be prepared.
In employment Tribunal work there are many variations to this reflected in the costs. Whilst we provide the estimates of costs above, this will ultimately be charged an hourly basis depending upon the work required to be done in your case. The estimate of costs being based on an hourly rate of £250 per hour for a grade A fee earner and £200 per hour for a grade B fee earner.
Any employment claim has key stages which include taking initial instructions; reviewing the papers, entering into pre-claim conciliation to ACAS, preparing the claims then submitting it, reviewing any response to the claim or preparing a response to claim by an employee, exploring possible settlement terms, preparing witness evidence and attending on court hearings and if need be, preparing and collating bundles for evidence for the courts. It may also include instructing a barrister to attend on your behalf.
