Islamic Marriage

In a recent judgment (July 2018), Mr Justice Williams, who sits at the High Court in London, concluded that an Islamic Marriage (Nikah) fell within the scope of the 1973 Matrimonial Causes Act. This means that Nikah marriages that were previously considered legally non-existent, may allow spouses to seek redress to the courts for a division of matrimonial assets such as the family home and spouse’s pension if a marriage breaks down.

Going through a divorce or separation is an extremely difficult time. However, it is vitally important that consideration is given to the division of your financial assets. We can support and assist you with this process and can often reach an amicable solution without having to attend court on your behalf.
