Financial Remedy Matters
If we undertake work for you in relation to financial matters then the fees will be charged at on an hourly rate based on the number of hours that we anticipate will be undertaken to conclude your case. Typically, this will range between 10 and 25 hours and the hourly rate will range from between £180 to £225 per hour plus VAT depending upon the fee-earner involved in the work. The exact cost will depend on the individual circumstances of each case. It will also depend on the complexity of the finances, the assets of the marriage and the disputes between the parties, such as how those assets should be distributed and taking into consideration meeting the needs of the family and in particular any dependent children.
For example, if there are children to consider and/or property to consider then depending upon the extent of the assets of the marriage, will depend upon the number of matters that may need to be investigated and determined to be able to advise on a fair outcome. In addition, if the parties have pensions, these will be a relevant factor in determining the outcome of your case. In the course of our work we will endeavour to settle the claims for financial relief and try to keep costs to a reasonable minimum but it will be appreciated that this will depend upon the attitude and conduct of the other party to the proceedings.
There are two ways in which a financial matter can be concluded being by way of consent order which generally avoids court proceedings and court hearings, or you may well have to make an application to the court for financial relief. On any application made to the court for financial relief, it is a pre-requisite for you to have attended mediation unless domestic abuse is a relevant factor in your case.
We estimate the average costs of resolving financial matters in a standard case will be between £2,000 to £4,000 plus VAT and the court fee of £303 on the issue of any application for financial relief if your case proceeds to court. It may also be necessary to incur further disbursements including the cost of valuations of property, valuation of pensions and/or a business. These will depend and differ on a case by case basis and we will advise you if it is necessary in the circumstances to incur such disbursements. An estimation of costs of these reports can be obtained before the experts are instructed.
