How can we help?
Our in-house NHS experts have previously worked with the NHS for over 10 years specifically with Primary and Secondary Care Service Providers and Commissioners. This extensive expertise, prior to 1st April 2013 was achieved in the main by advising Primary Care Trusts across West Yorkshire on all aspects of contracting and Primary Care Services.
We are able to provide a unique and practical insight into Primary Care Services from both the commissioner and provider perspective. We understand the pressures that the NHS and Social Care is under and will effectively balance regulatory requirements with local and national pressures alongside delivering safe and high quality care. We have a deep understanding of those challenges and work to get the best results for you, whatever your circumstances.
Partnership Agreements and Disputes
It is important to ensure as GP’s you have partnership agreements and where appropriate we can assist with negotiating and documenting the engagement of new partners. If necessary we can handle complex and sensitive partnership disputes, acting for either the practice or the individual partner. This can sometimes include mediation, arbitration and court hearings, ensuring that your contractual relationship with NHSE/the CCG is managed throughout the process.
Practice Sales, Mergers and Joint Working
When and if it becomes necessary we can provide advice on the sale of GP practices together with advice on the transfer of GMS contracts and PMS Agreements, and CQC registration requirements.
Construction and/or Refurbishment of Healthcare Premises
One of the essential foundations of healthcare is improving the patient journey, as well as maximising the range of services provided. To achieve this effectively, both the project plan and the interests of the GP surgery premises need to be properly documented. We can advise on the appropriate procurement route and on the most appropriate construction related contracts that are fit for the provision of modern healthcare services.
Contractual & Performers List issues
We can advise on when action is proposed or initiated to remove or suspend a medical practitioner from the List. In the unfortunate event a dispute arises we advise on the resolution of the same arising from GMS contracts and PMS agreements.
We provide advice on all GMC matters including performance reviews, registration appeals, specialist list appeals, and representation at fitness to practise hearings.
Clinical Negligence Claims
Our team, which includes lawyers and colleagues with NHS experience bring particular insight and understanding to the management of such claims, providing advice to doctors and other healthcare practitioners on the defence of clinical negligence claims.
A provider organisation can sometimes be a useful vehicle to deliver new and innovative services, which can be formed as part of a GP federation and or super-practice. We can advise on setting up provider organisations and joint ventures between GP federations, between GP practices for sharing resources and community pharmacy companies.
Commercial Contracts and Procedures
Our in-house NHS expertise means we have an established reputation for providing commercially focused, practical legal advice on commercial contracts and procedures. We can review and negotiate commercial contracts on your behalf, as well as provide succinct and practical advice on the correct contractual route to follow, thus minimising contractual risk to your GP practice.
